IMPORTANT: by using the web site at www.welshcurryhouse.co.uk (“the site”) you are accepting these terms and conditions. It is therefore important that you read these terms and conditions carefully.

If you do not agree to any part of these terms, or if any content of the sites is illegal in the territory where you currently reside, then please do not proceed.

Interpretation

Headings do not form part of these terms and conditions and will not affect their interpretation.

In these terms and conditions, "you" refers to the reader or user of the sites and "we", "us" refers to The Festivals Company Limited, a private limited company registered in England and Wales.  The site is the collection of web pages and associated content wholly under our control with a uniform resource locator (“url”) beginning with http://www.welshcurryhouse.co.uk

Terms relating to the Welsh Curry House of the Year Competition 2012

Public vote
The general public are invited to vote for their favourite Indian restaurant on-line at www.welshcurryhouse.co.uk or by returning a paper voting slip to The Festivals Company.  Vote lines are opened and closed as specified on the site. Votes received outside of these specified times will not be counted. We may suspend, withdraw or re-set voting at our sole discretion at any time.

We reserve the right to discount votes if we have reasonable grounds to suspect that fraudulent voting has occurred.

The Festivals Company, its sub-contractors and/or agencies do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any network, system, server, provider or otherwise which may result in any vote being lost or not properly registered or recorded.

To vote for a restaurant you must fully complete the on-line form or a paper based form given to you by a competing restaurant.  The validity of data collected on-line and on paper may be checked as part of our process of ensuring voting is fair.

1. Your Name
2. The time when you experienced problems
3. A description of the problems you experienced
4. A contact telephone number

Queries will be addressed as soon as possible after we have received them.

Determining the winner of the Welsh Curry House of the Year 2012

At the close of the public vote we will identify the 30 restaurants with the highest number of votes.  The 30 will be divided between the the three regions as follows: Mid and West Wales 5; North Wales 10; South Wales 15.  In the event that there is a tie the ranking will be determined by the judging panel considering the reasons given by each voter.

The regions are defined as follows: South Wales comprises the local authority areas of Monmouthshire, Torfaen, Blaenau Gwent, Newport, Caerphilly, Merthyr Tydfil, Rhondda Cynon Taff, Bridgend, Neath – Port Talbot, Vale of Glamorgan, Cardiff, Swansea; Mid and West Wales comprises the local authority areas of Carmarthenshire, Pembrokshire, Ceredigion and Powys; and North Wales the local authority areas of Ynys Mon, Gwynedd, Conwy, Fflint, Denbighshire, Wrexham.

Each restaurant that is identified in the top thirty will be visited by representatives of the judging panel who will take a meal in the restaurant.  A points score will be calculated by the judges which takes into account (in equal measure) the quality of the food, the ambiance and environment, the service and value for money.

The restaurant with the highest points score from each region will be visited by the full judging panel.   At the end of their visits the judging panel will review the performance of each restaurant and determine the winner of the competition.

The decision of the judging panel is final and no correspondence will be entered into.  The Festivals Company Limited reserves the right to suspend, terminate or otherwise amend the processes at its sole discretion.

Refund policy

Nothing in this Refund Policy will affect your statutory rights under the laws of England and Wales.

Tickets to events purchased through our site are sold on a non-refundable basis.  If you believe a payment has been made in error please contact This e-mail address is being protected from spambots. You need JavaScript enabled to view it - refunds will be made at the managers discretion.

If you have paid for goods then you have the right to return them within seven days of receipt for a full refund without penalty.  Where the goods are faulty we will meet the cost of return; but you will need to cover the cost of return if your return goods as a result of a 'change of heart'.  In all cases please contact This e-mail address is being protected from spambots. Delivery Policy

We will acknowledge receipt of your order and payment as soon as practicable within usual UK working hours.

If you pay at our site for tickets to events or other goods then we will either despatch them as soon as practicable via first class post or make them available for your collection as advised during the ordering process.

Should you fail to receive any acknowledgement, tickets or goods within 14 days of placing your order please contact us.

 

Personal use only
Any material on the sites is strictly for personal use and must not under any circumstance be used by any user for commercial purposes or used in a defamatory or derogatory manner. Material must not be duplicated in any way for use outside of the sites as this is in breach of international copyright and intellectual property laws.

Your Indemnity
You agree to indemnify (reimbursing all liabilities, costs and expenses actually incurred) us against any costs, claims, liabilities or expenses arising out of breach of these terms and condition and to keep us so indemnified at all times.

Use of material you submit
We reserve the right to use any material submitted to us during or after the competiton process for online and offline promotional purposes without limit on time or usage. We try to contact originators of such material prior to its use but we do not have to do so.

Ownership of trademarks etc. on this website
The trademarks, logos, names and images displayed on this website are the registered or unregistered trademarks of the company and others. Except where expressly stated to the contrary, nothing in this website confers any licence or right to use any trademark displayed on this website without our prior written approval or the owner of the relevant trademark. We reserve the right to notify you via email of news and other information in connection with the competition to find the Welsh Curry House of the Year 2012.

Downtime
We may occasionally have to perform necessary network maintenance and/or network upgrades. We will try to give 24 hours notice of any scheduled maintenance but you  must be aware that, at any time, we may perform emergency maintenance as needed to preserve the overall integrity of the services with no notice and with without compensation for such activities.

Right to alter or suspend any site, service or feature
We reserve the right to alter or suspend any site, service or feature at any time without prior notification or explanation.

Rights in website content
All rights, including copyright and database rights, in the sites and the content thereof are owned or controlled by us. We retain all copyright, database rights and other intellectual property rights in material contained on or in relation to the sites and you may not copy, reproduce, download, republish, extract, broadcast, transmit, display, modify or re-use any of the materials on the sites for any other purpose.

Users and others shall be entitled to set up hypertext links from their own websites to the home page only of the sites.

Exclusion of liability for linked websites
Whilst we exercise reasonable care in the selection of websites to which we link, we do not control their content, format or availability. Therefore:

  • we give no warranties, endorsements or recommendations in relation to any products or services mentioned or any statements contained in third party sites;
  • we disclaim all responsibility for any content you encounter, or events which may occur once you have transferred out of the site and are not be liable to you or anyone for any damages or other losses of any type whatsoever incurred by visiting a linked site.

You agree that whilst we take all reasonable measures to ensure the truth and accuracy of information on the site, we are not responsible for any wrong, inaccurate information  and you are advised to independently verify such information before relying on it.

Exclusion of liability for viruses, etc
Whilst we take all reasonable precautions to protect the sites and its users against worms, viruses and other harmful material, before downloading or using any potentially harmful material on the site, you are advised to ensure that your systems have up-to-date virus detecting software and have that software check the safety of any materials. Therefore, we do not accept responsibility for any defects, viruses or other harmful components that may be contained within any of the sites.

Termination of website use rights
A user's authorisation to use this website automatically terminates without notice if the user fails to comply with any of these terms. On termination, the user must cease all use of the sites.

Right to amend these terms
We may at any time revise these terms by posting changes on the site. The continued use of this website after changes are posted constitutes your acceptance of the modified terms.

Applicable laws
These terms are governed and construed in accordance with the laws of England and Wales. If any of the terms is held to be unlawful, void or for any reason unenforceable, then that provision will be deemed severable and will not affect the validity and enforceability of the remaining terms. You agree to submit to the non-exclusive jurisdiction of the Courts of England and Wales.
